Sino Legend Prevails in Landmark Legal Challenge; Court Rejects SI Group Trade Secret Arguments

ZHANGJIAGANG CITY, China--()--Following an extensive review of facts presented over several months, Shanghai No.2 Intermediate People's Court this week ruled in favor of Sino Legend (Zhangjiagang) Chemical Co., Ltd. in two landmark patent application rights and trade secret infringement cases. All claims brought by SI Group Inc. and SI (Shanghai) Co., Ltd. in Case Nos. 48 and 50 were found to have no factual or legal basis.

“These rulings reaffirm that our extensive investment in research and development led to our innovative processes and products,” said Mr. Corey Xie, deputy manager, Sino Legend. “As advocates for ethical business practices and competition, we’re pleased that both parties were provided ample opportunities to share relevant information, data and expert opinion with the Court, allowing for a thorough assessment and fair decision.”

In both cases, the Court found that more than half of SI’s claimed trade secret were invalid since they are not “unknown to the public.” In addition, it ruled that Sino Legend technologies incorporated in its tackifying phenolic resin patents and SL-1801 tackifier are not identical or materially identical to any SI trade secret.

In both cases, the Court dismissed all SI claims pursuant to Article 10 of the Law of the People's Republic of China Against Unfair Competition; Articles 9, 10, 11 and 14 of the Interpretation of the Supreme People's Court on Certain Issues Concerning the Application of Law in the Adjudication of Civil Cases Involving Unfair Competition; and Article 145(2) of the Civil Procedure Law of the People's Republic of China.

In less than five years after beginning full-scale production, Sino Legend has become the largest Asian manufacturer of resins for the tire and rubber industries, holding 70 percent of the Chinese market and 30 percent share for the rest of Asia. The company is a supplier to eight of the top ten multinational tire companies operating in Asia, as well as to the majority of China’s domestic manufacturers.
